The Justice department s petition argued that a company should not be required to prove it engaged in past Dis Crimi i nation before setting up such a program i for minorities. Having to comply with such a require 1 ment would leave employers open to Law suits for Back pay and other damages the department said. And the petition said there would be less compliance with Federal executive or Ders conditioning government contracts on efforts to improve minority Job opportunities. Factory worker the test Case involves Brian Weber a White factory worker at the Kaiser alumni num and chemical corp. Plant in Gram Ercy  sued when he was denied a spot in an on the Job Craft training program be cause openings went to Blacks under a voluntary affirmative action program. The program was set up in a collective bar gaining agreement Between Kaiser and the United steelworkers  rulings before the supreme court s Bakke decision a District judge and the 5th . Circuit court of appeals sided with Weber. The company and the Union appealed to the supreme court. The Justice department said the High court should Send the decision Back to lower courts in Light of the Bakke decision which held that while race can be a Factor in University admissions it must not be the Only one. The government said the appeals court in the Weber Case was unduly restrictive in ruling an employer and Union can not agree on such programs unless they can prove that the employer engaged in unlawful  we believe that this ruling is incorrect the petition said. Moreover if permitted to stand the decision can be expected to chill voluntary affirmative action programs not Only in the 5th circuit but throughout the  Justice department contended that the 1964 civil rights Law permits voluntary affirmative action programs where an employer and Union have a reasonable factual basis for concluding that a plaintiff could establish employment discrimination. That was 8,415 More than on tuesday and 2,301 More than on wednes Day but still 16,950 less than expected. Officials also disclosed that attendance at those schools had reached approximately 82 percent up from an estimated 73 percent on tuesday and was More than that anticipated at schools involved in voluntary integration programs. Boycott organizers however noted that those numbers included pupils of All races and All grades. They said private checks indicated that at least three fourths of the White pupils and one fourth of the minority pupils Given mandatory busing assign ments had ignored them. Bus top attorney Tom Bartman a Leader of the group trying to get the plan stopped through the courts predicted that two thirds of the Anglo children assigned to be bused May have left the District for Good. Miller promised More exact figures this week but insisted that the actual numbers Are irrelevant. I Don t think it s a pretty picture to see those who oppose this plan circling like vultures Over a mythical body count which they themselves Are producing he said. I think in All decency it is time to lend support to those thousands of people who have attempted to make this work. The real Story now is what s going on in these classrooms with these Low student teacher ratios with kids learning in an integrated environment with racial isolation broken Down.
