Family Home source says by Rosemary Sawyer staff writer Wiesbaden West Germany Wiesbaden Mili tary officials Are sending to the United slates the family of a boy apprehended monday in connection with the arson of a Wiesbaden Garden House an american source said thursday. The boy was one of two Ages 12 and 14, picked up by German police about 5 30 . Monday after a fire destroyed an unoccupied Garden hut near the Aukamp military housing area. Wiesbaden police commissioner Hans Josef ram Burger said he was told the father of one of the boys has offered to pay for the damage to the Garden House which a tire department spokesman estimated to be 3,000 Marks or 11,600. It was unclear which of the boys was being sent to the United states and which of the fathers offered to pay for the damage. The German Case against the boys has nol yet been forwarded to the prosecutor s office because it is still under investigation Ramberger said. Although Only the 14-year-old is old enough to appear in juvenile court charges were filed against both boys in the name of the Garden House owner he said. The German prosecutor s office can decide to prosecute the older boy or pass jurisdiction to . Authorities. By German Law if the prosecutor s office chooses to retain jurisdiction in the younger boy s Case the parents could be charged with neglect. However the terms of the status of forces agreement prevent a German court in such a Case from prosecuting a . Service member Parent Ramberger said. If the parents decide to leave inc country with the boys there is nol much that we can do to keep them Here especially with the 12-year-old," Ramberger said. Ramberger also said charges have been filed against a girl who allegedly killed a Kitten aug. I in another incident in inc Garden Pool area. The Kitten s owner Lydia Weber said the girl threw the animal to its death when she was caught stealing it. Weber who operates an animal shelter for sick old and unwanted animals in the Garden Pool area lost 11 pets in a series of killings last month. The girl s Case also is still under investigation ram Berger said
