German loses court bid to restrict smoking Munich West Germany is a bavarian constitutional court rejected on thursday a West German citizen s year old attempt to put restrictions on smok ing in restaurants. The citizen whom court officials declined to identify had claimed that the Munich City ordinance governing the food Industry was unconstitutional be cause it allowed smoking in restaurants while restricting it in other commercial food preparation settings. He sought to have the court ban smok ing in Munich restaurants or barring that require each restaurant to set aside an area for non smokers. The court rejected his claim deciding that while the state Constitution May empower cities to ban smoking in restau rants it does not require them to do so. Even if the exception in the ordinance were removed the court ruled the Ordi Nance applies Only to food service employees and not to customers.
