European Stars and Stripes (Newspaper) - September 14, 1967, Darmstadt, Hesse By Spencer Moosa a staff writer i in Yutang author philosopher scholar is rediscovering his coun try and his people on the Island of for Mosa after 30 years of wandering the world. Three decades ago he set out to inter pret the chinese to the West writing in English and he was an immediate Suc Cess. His first Book appropriately was my country and my it painted a thoughtful sometimes whimsical occasionally bemused Pic Ture of his countrymen. It traced their origins their Way of thinking and their strengths and weakness. Appearing in a time of crises Chinakas soon to fight for survival against the japanese militarists it had powerful Impact on Public opinion abroad helped stir up sympathy for the nationalist cause. In subsequent works Lin had som Sharp words for the corruption of chinese political life. But his sympathies remained largely with the Kuomintang. Now 71, better known abroad than up among the chinese he returned to the Small Corner of China Stid in nationalist hands to spend the rest of his life. He explained Why he came to for Mosa for 30 years i have lived abroad in the United states and France writing for the Western Public. 1 Felt guilty toward the chinese Public. That Why i came the years have been kind to Lin you Tang financially. His books were not Only critical but popular successes. He live sin a rented Villa with a swimming Pool on Yang Ming Mountain the Best Parton town while waiting Foi his new House to be built. Small Peppery bespectacled Lin has made an outward transition from the West to the East. Taking his pipe from his Mouth Lin philosophize we Are Here to enjoy life and to make the Best of it. So Man of us forget the philosophy of enjoyment of life and make ourselves slaves to our work. Here in this vast Rich universe so marvellous and Beautiful life has been made complicated often miser Able sometimes unbearable because beget too involved in our private Ambi on smoking i smoke a pipe Allday. I smoke a pipe to get into the contemplative state of mind. 1 smoke cigarettes As a stimulant. The effects Are entirely dissimilar. The cigarette stimulates the pipe soothes the on work i believe in regularity and concentration. I do not believe in inspiration for authors. Those who wait for inspiration will probably never come by it somewhere in the human Bod there is a mysterious clockwork the body likes to be regular and we accomplish most by leading a regular on philosophy "1 believe the True function of philosophy is to teach us How to make the Best of our life an enjoy it. In other words a philosopher is a Man who takes a detached View on life life May be very complicated or the material world May even be an illusion but we have to take common sense Point of View we Are Here and let us make the Best of Ann Landers dear Ann Landers Ever now and then you print a letter from a teen Ager who think she knows it All and insists she is mature enough to get mar ried. Sorry dear readers i could Rint a letter similar to this everyday of the week but what s the use Are you listening out there i Hope so. 1887, publishers newspaper Syndicate the stars and stripes seat belts and the Law i would like to know the Legal basis for Usa eur s order re Quiring everyone to Wear seat belts. The Only basis for exercise of police Power under our Constitution is to prevent actions or behaviour that will endanger or injure others. A person who fails to Wear a seat Belt is not endangering anyone else. He is Only endangering himself and there is some disagreement among safety experts As to the value of seat the Best of my knowledge there Are no Laws requiring the wearing of seat belts in the . Such Laws Are confined to requiring the installation of seat belts. Use of them is an individual s own a second Point. 1 would like to know who la legally responsible if a person who is wearing a seat Belt under Susareu directive is injured. There have been reports of people injured because of wearing seat belts particularly Lap belts. 1 am an employee of a . Government Agency which has Lap belts in its official cars. If i sustain injuries because i am required to Wear the Lap Belt May i sue the Usa eur commander in chief for damages i know that Usa eur maintains that a Driver s License is a privilege not a right. However i do not believe this position can be sustained in a court of Law. If a person loses his License As a result of failure to fasten seat belts he has been deprived of his right to travel freely without due process of Law even though his actions have not endangered any other person. This was the very Point taken by the supreme court in regard to passports. The state department maintained passports Are a privilege an could be denied or taken away by administrative action. The court ruled they were a right and could not be denied or taken away without due process of Law. I am certain the court would give a similar ruling on Pov Driver s licenses if the Issue were taken to court. Name withheld by request editor s note he Usa eur replies 1the seat Belt order was not issued As an exercise of police Power per be but pursuant to the commander in chief s author Tyas a major commander to Issue rules and regulations governing conduct which bears a reasonable relationship to the safety health welfare and morale of his command. It is this same authority when combined with the specific consent of the Federal Republic of Germany in International agreement which permits cinc Usa eur to establish the existing Pov operator s licensing and registration systems with the Fri for members of the . Forces the civilian component and their dependents.2in spite of the writer s assertions to the contrary there is substantial agreement Between recognized safety and medical authorities in the ., As Well As in this command that seat belts definitely improve the wearer s chances of avoiding death or serious injury in traffic accidents. Because injury or death of members of Usa eur and their dependents adversely effect the Mission of this command regarding such factors As Man hours lost combat readiness dollars spent and general morale cinc Usa eur May legally require the wearing of seat belts As a condition attached to the operation of toys in this of Speed limits plus unfamiliar Road conditions and driving habits Are also factors which support such a requirement. This office is unaware of any recent court cases altering the Long line of . Decisions which hold that operating a private motor vehicles in fact a privilege to which issuing authorities May attach reasonable conditions.3for the writer s information . Statutes permit persons who Are not members of the military or civilian component Tofile claims against the . Government for negligent acts off its employees. To obtain favourable consideration however proof would be required that injury or damages were in fact caused by the wearing of a seat Belt and that the order requiring the Belotto be worn was in fact issued wrongfully or negligently by army authorities. Pernicious sentiment1 a recent article in which a retired general proposed to the vow of California that the military take Over the United states needs something said against it and i am indignant enough to attempt As much. Such a sentiment is so pernicious to the democratic system of the . That it makes the recent rash of hate mongers and the communists As Well look like a mob of kids with water pistols. Is the general proposing that when the going gets rough we abandon the democratic system for the Law of Rifle an tank he evidently has Little Faith in the principle of the Ameri can Way. What Law does the retired general respect that he can make so Light of the american Constitution Are we to be no better than the communists who do not attempt to fit their Aims within the framework of the Law but change the Law Willy Nilly to fit their Aims i Grant that a retired general perhaps does not express official opinion and that your newspaper states that it is an unofficial Organ of the . Forces. But in a time when people speak of responsibility before the Laws no one must be permitted to speak rashly with impunity. And you evidently believed the re tired general s opinion significant enough to publish them where hundreds of thousands of military people read them every Day and especially High school dependents who Are in the processor learning what the american Way of life is. It is not because i wish my opinion alone to be published but As much for these individuals that i Hope you will see fit to publish this letter in your newspaper. I doubt that i am alone in these germs Zelliams Frankfurt editor s note the writer is referring to the views expressed by Brig. Gen. Robert Scott Usan re before a meeting of american legion Post 131 in Santa Ana Calif. Scott stated that a military takeover might be necessary if professional politicians were not Able to keep Law and order. The Story reporting these views was printed because it was Felt to be of views interest to our readers. The reporting of such views does not constitute ail endorsement of them in any Way Auy More than reporting an automobile mishap Means stripes or anyone else is in favor of accidents.
