President Bush on Friday signed legislation authorizing funding for the state department. Many provisions of this act could be read to violate fundamental constitutional principles by using legis lation to direct. Hampden county sheriff Michael Ashe said he took the action to pre vent the collapse of the criminal jus Tice system in this county due to Lack of correctional  it appears. There is an Immi nent danger of a breach of the peace due to insufficient prison space in this county and that reasonable and Pru Dent Steps must be taken in order to preserve the peace and quell such danger Ashe said in a directive to the brigadier commander of the Massachusetts army National guard armory on Roosevelt Avenue. The dramatic announcement at 2 . Caught state officials by Surprise and there was Little immediate re action from National guard officials. West Field District judge Philip Conland detained two Hampden county deputies for most of the Day when they refused to take a prisoner Back to Lite jail acting on Ash s orders.
