Attorneys for the Legislatures democratic leadership argued that proposition 140, which also made a $70 million or 38 percent Cut in the legislature s budget would unconstitutionally restrict a legislator s right to run for office and a voters right to choose a candidate. The majority opinion by chief Justice Malcolm Lucas said the Public s interest in easing what critics have called legislative gridlock in Sacramento outweighed complaints about the restrictions. Lucas also rejected the argument that the measure required such a fundamental change that it should have been considered a constitutional revision which requires initial legislative approval and can t be done by initiative. Justice Stanley Mosk a former state attorney general and the Only democratic appointee on the seven member court dissented.
