The Case is an Appeal by followers of santeria an ancient african religion practice by thousands of Caribbean immigrants to the United states in which animal sacrifice plays a Central ceremonial role. The Hialeah City Council enacted the ban in 1987 after a group of santeria followers leased a used car lot and announced a plan to build a Church in which they would sacrifice chickens doves ducks goats pigeons sheep and turtles. The group known As the Church of the Fukumi a Balu Aye inc., sued the City on the ground that the ban violated the first amendment right to free exercise of religion. Two lower Federal courts upheld the prohibition. Though animal sacrifice is in exotic practice far from the mainstream of american religion the potential implications of this Case Are much broader at a time when the supreme court is actively re examining its approach to Church state issues. In a Case involving prayer at Public school graduation ceremonies the justices Are already reviewing their approach to the first amendments establishment clause which prohibits official actions that amount to an a a establishment of religion. The court May Well be planning to use the new Case to conduct a similar review of its interpretation of the other religion clause of the first amendment the free exercise clause. At the least this Case is Likely to clarify the courts last major pronouncement in the free exercise area supreme court much disputed 1990 decision holding that the first amendment offered no Protection against state drug Laws to people who use the Hallucinogen peyote in religious ceremonies. Federal Law and the Laws of 23 states allow the sacramental use of peyote which is part of the ritual of the native american Church and Nas been used by some american indians for centuries.
