Thanks to Louis a couple of car loads of very Happy americans will be driving to Holland for a once in a life time event a Catherine g. Duller Ramstein All Germany Berlin casualties i was somewhat appalled to see in the stars and stripes the article last week regarding Berlin brigade soldiers passing out during a Parade. This bothered me for two reasons first is this newsworthy certainly the last ceremonies in a unit with a legacy for parades required attention but the a body county of soldiers who passed out. Second with the importance of the final ceremonies Why did so Many sol Diers fail to meet the standards i was privileged to observe the change of command ceremony for the v corps special troops in on july 7. Not too newsworthy but i saw two platoons of Normal everyday soldiers of mixed race sex and military specially and a platoon of German soldiers from the ii German corps perform admirably in extremely hot weather that quickly turned to a Driy ing rainstorm with lightning and Hail. During the 40-minute ceremony not one v corps or German Soldier failed or by the weather. Obviously a casualty of the draw Down is the discipline Pride and conditioning we used to maintain in the Berlin brigade. I was honoured to be a part of that unit. I personally participated in two a Parade seasons Quot and observed two others. These four occasions covered. Extreme heat and once dressed in class a a a so a cold rainstorm. During All these i never saw a Soldier in my unit fail to maintain his bearing. It just was not done. Period we had too much Pride in ourselves our unit and our leaders. No one wanted to let their comrades who were also under the same conditions Down. No one also wanted to Embarrass our uniform in front of the allies berliners or russians present at each ceremony. We were fit disciplined and conditioned. So is this what we can expect from the army of the?T90s? a maj. Carl w. By Franklin Strier special to the los Angeles times speculation is rampant about . Simpsons chances at the hands of a jury. But the debate Over fairness pretrial publicity celebrity and so on misses the Point. It is an enduring and profound truth that juries have never been reliable vehicles for the equitable Resolution of trial court disputes. Here a Why a the american Lay jury is a howling anachronism. Originally effective during colonial times As a bulwark against the judges appointed by. England the jury today has become a Pawn in the hands of skilled and Well financed litigators. As modernity brings us More complexity continued use of the Lay jury for Many litigated disputes is dysfunctional. Uninformed and unjust decisions result. A the Law abides the Paradox of jury lawlessness. This phenomenon also known As jury nullification is unique to american Law. Initially jurors Are sworn to obey the judges Legal instructions. Yet in deliberations the Power of jurors to ignore the Law is inviolable defended by pillars of the Bench and bar alike. A the adversary and jury systems Combine to deliver a witches brew of trial jus lice for years Crafty attorneys have prevailed in contravention of the merits of their cases by plying myriad forensic tricks and pandering to the basest of juror emotions. A disparate financial resources Between litigants skew jury trial results. The wealthier the litigant the better the available Legal representation. A antediluvian procedural rules cripple even elemental jury fact finding. While the Law reposes the most solemn obligations upon the jury a determination of guilt or innocence in criminal cases assignment of rights duties and damage awards in civil cases a it denies jurors Basic Independent fact finding tools. Most courts for instance forbid jurors questions take notes or see a transcript of the testimony. I Call this the jury a idiot savant syndrome. A most judicial instructions Are worthless. Rather than explain or clarify the Law the judges instructions usually confound the jurors with jargon Laden in comprehensible language a worded to avoid appellate reversal not to guide jurors. Consequently jurors commonly deliberate and vote in ignorance of the Law As Given from the Bench referring instead to their personal values and biases or succumbing to the emotions evoked by attorney pandering. Bad jury verdicts those Abr sively i consonant with both the Law and common notions of Justice and decency a Are not the product of some misguided new morality but rather Are and have always been endemic to our jury system. Needed reforms would first remove Complex and technical cases from juries and then empower juries in the remaining cases. Engaged jurors Are More effective jurors. Allow them to ask questions and take notes. In deliberations permit them to retrieve from computers any part of the transcribed testimony or the judges instructions. Use Neutral instead of partisan exper witnesses. Above All reword instructions so that if jurors want to follow the Law they can actually understand it. Strier is editor of the journal of business and management at California state University Dominguez Hilis a Jet of course i m a cop so a that / you re a material witness you m16hthave7u testify and you cant be to step
