The student Marco def Unis jr., won a state court ruling admitting him to the Law school but the Washington supreme court overturned the decision on March 8. Def Unis s lawsuit attracted wide Atten Tion in Legal circles because of its Impact on Many recently developed programs to provide a Legal education to Blacks who cannot qualify under the Normal Entrance requirements. He has remained in school while the Case has proceeded from court to court. He told the High court that of 150 applicants admitted in september 1971, 44 were minority students of whom 38 had qualifications lower than his. The justices in a Brief order said they would decide a closely watched Detroit school Case requiring busing Between the City where 65 per cent of the students Are Black and 52 suburban jurisdictions where the student population is 80 per cent White. A final ruling is expected next Spring of Early summer. The decision will affect numerous other cities Hartford Indianapolis Wilmington and Atlanta among them where lawsuits involving metropolitan wide desegregation Are under Way. Last May the supreme court on a 4-4 vote barred the merger of predominantly Black schools in Richmond va., with the mainly White schools in two suburban counties. Milliken of Michigan and the 52 suburban jurisdictions involved in the Case. They Are challenging a 1972 ruling by . District judge Stephen Roth who held that desegregation limited to the City of Detroit would Lead to an overwhelmingly Black school District there. Last july the 6th . Supporting Roth s positions the panel said we see no Validity to an argument which asserts that the constitutional right to Equality before the Law is hemmed in by the boundaries of a school  no faithful adherence in its Appeal to the supreme court Michigan said the lower court rulings did not represent a faithful adherence to the Constitution and the binding precedents of this supreme  instead Michigan atty. Gen. Frank j. Kelley said the rulings were an attempt to use the Law As a lever in attaining. The desirable social goal of Multi school District racial balance throughout a huge three county  the Blacks who won the lower court Rul Ings vigorously opposed review by the supreme court. Their lawyers said the de troit Case was not ready for a ruling by the justices. This is because the Case has been re turned to Roth for hearings at which a specific busing plan for Detroit and its suburbs will be worked out they argued. No advisory opinions under these circumstances decision of the issues presented in the petitions at this stage of the proceedings would virtually require an advisory opinion they said. The justices do not hand Down advisory opinions. The lawyers Are understood to fear that Justice Lewis f. Powell jr., who did not participate in the Richmond Case will add a fifth and deciding vote to the opposition to City suburban busing. Powell in a concurring opinion in the Denver school Case last june voiced Strong opposition to busing. The vote tally in tie cases is not revealed but it is believed that chief Justice Warren e. Burger and justices Potter Stewart Harry a. Blackmun and William h. Rehnquist were the four who blocked City suburbs busing in the Richmond Case. Soaring wheat prices make bread costs jump Washington a soaring wheat prices at the farm Are the major reason Why bread has gone up five cents a loaf at the supermarket during the past year according to a new government study. The average retail Cost of a one Pound loaf of White bread in september was 29.5 cents up 4.9 cents from july 1972. Of that increase higher prices for wheat accounted for three cents according to agriculture department figures. When other farm produced ingredients such As shortening and milk Are included the farm value of products in a loaf of bread was a record seven cents in septem Ber up from 3.6 cents in july last year. The new figures Are included in the quarterly marketing and transportation system report issued by the department s economic research service. Retail bread prices went up sharpest in september averaging 2.3 cents per loaf More than in August and three cents More than july the report said.
