Berkowitz was arrested on aug. 10 for killing six people and wounding seven with a .44 bulldog. Or. Daniel Schwartz chief psychiatrist takings county reported to the court that Ber Kowitz is mentally incompetent to stand trial. Or. Schwartz conclusion is the same As that arrived at by every policeman i know who questioned Berkowitz on the night he was a  letter from Berkowitz postmarked aug. 25, reads dear or. As a result of mental disease or defect and that he lacks capacity to understand the proceed Ings against him or to assist in his own  the rest of the report is being kept secret from the Public simply because the Legal Busi Ness feels it is a privately held organization. And so we Are left with a letter that appears to be written by a person As capable As any body who rides the subway to work each morning. And on the other hand we Are left with a Short opinion from a highly reputable psychiatrist a Man who spent much time with Berkowitz but who is allowed to give us Only a few  the Federal courthouse located Only a few Yards away from the state supreme court building in Brooklyn the rules of disclosure probably would Force the release of or. Schwartz report immediately. Why Newyork state cannot follow the Law of the coun try is another reason for Public mistrust of Justice As it is administered on the local level. If Berkowitz is ruled incompetent by the court he will be sent to a mental institution. Sometime in the future if doctors at his institution decide that he is competent to stand trial Berkowitz will be sent Back to Brooklyn for a murder trial. The evidence against him will be waiting. At the trial Berkowitz can be found guilty and sentenced to 25 years to  it can be found that Berkowitz was insane at the time of the crimes. If this is the result Berkowitz again will be sent Back to a mental institution. The years probably will add up to much of a lifetime before any attempt to get Berkowitz out could be , if the court decides in a compe Tency hearing on oct. 6 that Berkowitz should stand trial the door is opened to a possibility that the Guy will be out on the Street years ear Lier than he Ever could be if the ruling of in competency is allowed to  is the distinct possibility that once inside a mental institution Berkowitz never will be released. Which would make All con Cern academic. But for those who live through son of Sam there is a profound need for something stronger than the possibility the people want to know the Guy won t Back.
