Spinks 18, had been ordered to appear last Friday before circuit judge Thomas w. Challis to be sentenced on an assault conviction. His lawyer speculated at the time that Spinks might have forgotten about the court Date in the excitement Over his brother s championship fight with Muhammad Ali Friday night in new Orleans. However police said Spinks told them he did not go to new Orleans and he did not show up in court because he did t have enough Money to pay his Fine. Spinks arrested at his apartment in the Darst Webbe housing project was convicted aug. 10-of assault with intent to kill without malice in the shooting last novem Ber of Billy Dunlap 19. The jury recommended punishment of three months in jail and a $100 Fine. Under state Law Challis could not impose a stiffer sentence than the jury s recommendation. However Spinks would Only have to pay the Fine because he spent three months in jail before he was Able to Post the $7,500 Bond.
