One Day in january the new England patriots lose a game to the Chicago bears 46-10, while half a nation watches and the following Day the coach says that several players on the team have had drug prob in each Case the observer wonders what significance if any the aspect of drugs had on performance. We wonder what arc we watching this is a major problem for the businesses that arc sports. To maintain the integrity of their game and the integrity of their image is essential. It is their Selling Point. It has not been determined conclusively How much drug taking can affect or impair performance or in the words of physicians psychomotor and arc the effects different from the alcohol that babe Ruth imbibed or the admitted hangovers Mickey Mantle suffered before hitting for the Cycle nonetheless each of the three professional leagues that have had headline drug problems has had a collective bargaining agreement with its players associations in regard to drug abuse. Generally these agreements have followed the lines of Many prominent organizations beyond sports such As ism and the United mine workers and those even in such crucial professions As teachers and safety and health related occupations such As airline pilots. There is As a Rule no routine or random drug testing in those Fields. When an employee indicates some problems in regard to health and safety or performance that is when there is probable or reasonable cause then he or she is sent to a doctor usually an impartial doctor not one on the company payroll to be tested. And if a test is Posi Tive a period of rehabilitation is usually agreed upon. Trabert Qew questions of probable or reasonable cause arc essential to morale. It May not be that random or forced on the Job testing is a violation of the fourth amendment. The fourth amendment unless a local privacy statute has been enacted deals almost solely with government intervention a police officer can t rum Mage through your Bureau drawer looking for stolen stockings unless he has a warrant from a judge who has determined reasonable however private employers can generally get a More sweeping compliance from employees unionized or not. The private employer sets the guidelines and the employee or prospective employee agrees or does t agree. If he does t agree he looks for another Job. Difficult to do in the monopolistic sports professions or the unions negotiate terms to the Best of their strength. Some private companies give blood tests for alcohol abuse and some test randomly for drugs. But there Are limits. When an employer forced an employee to vomit to seek evidence of chemical sub stance abuse this was found by the supreme court to be unreasonable search and seizure. Now there is a collective bargaining agreement signed in 1982, Between the nil and the nil play ers association. The agreement stipulates that there is to be no random or spot drug testing unless a player volunteers that he has a problem or that there is reasonable cause to suspect it. The new England Patriot players have recently voted to sidestep this stipulation. After the super bowl coach Raymond Berry be Lieving there was a drug problem on the team an opinion that met with Complete disagreement by the team psychiatrist had a team meeting and 90 per cent of the players agreed to voluntary random drug testing. The nil players association filed a grievance Over this with the National labor relations Board citing unfair labor practices after the patriots embarrassing defeat. Under threat of the coach re signing the players were in effect coerced into agreeing to testing. All to the Good according to the general run of nil management people. Tex Schramm president and general manager of the Dallas cowboys says that when an athlete signs to become a professional he gives up Many rights of privacy. This is True but what Are the limits is random drug sampling one what about lie Detector tests Secretary of state George Shultz who is in a somewhat More vital Posi Tion than the Middle linebacker for the cowboys was asked on general principles no reasonable cause to submit to a lie Detector lest for administration officials with Access to highly sensitive information. Shultz said in effect if you Don t Trust me fire and if athletes Are role models then to what extent do youngsters take drugs because they hear that athletes do most Young people Start to take drugs As a curiosity or because there is some problem at Home or at school said Michael ships director of the Pioneer House the adolescent and Young adult treat ment Center in Plymouth Minn. I pc never heard of anyone taking drugs because a prominent athlete though sports is much More visible than say Coal mining and though athletes May appear on Cereal boxes and Coal miners Don teach is still a citizen of the country not a thing apart. What s Good for Coal miners and for teachers and for airline pilots and for a Secretary of state should be equally appropriate for a nose tackle too. Sports fans should t expect anything More from our athletes than what reasonable cause provides to new Vork Tutti Aba from Page 21 scored All the remaining Points taking the Lead at 110-109 on a Basket by Curton with is seconds to play.
