The Issue involving separation of govern ment Powers is an arcane one with lawyers on All sides quoting theorists and scholars ranging from Montesquieu to Madison. The first $11.7 billion in spending cuts required by the Law took effect March 1, unaffected by the decision of the three judge panel that suspended its own ruling. The Law Calls for deeper cuts until All red Ink in the Federal budget is eliminated bv1991. Y the deficit stands now around $208 Bil lion. Gramm Rudman requires the figure be reduced to $144 billion for the next Fis Cal year which begins oct. 1. Barring new taxes or congressional approval of specific reductions to reach that deficit target automatic across the Board cuts Are mandated by the new Law. Half the Money would be slashed from the military and half from Domestic programs. The Gramm Rudman Law also has deprived Federal employees of a 3.1 percent Cost of living increase this year. The key provision that was declared unconstitutional by the lower court empowers the comptroller general to order automatic deficit reductions. Until now the position has been a rather obscure one. The comptroller general Heads Congress general accounting office a watchdog Agency that audits Federal pro Grams. He is appointed by the president to a 15-year term and can be removed Only by Congress. The three judge court said the Gramm Rudman Law breaches the separation of Powers Between the White House and con Gress by empowering a legislative officer the comptroller general to perform a Job reserved for the executive Branch. If the supreme court upholds the lower court ruling the comptroller general s role in ordering automatic spending cuts would be eliminated. But Gramm Rudman has a Fallback pro vision that would retain part of the mechanism designed to reduce the deficit. The congressional budget office and the office of management and budget in the White House would submit figures on How much spending must be trimmed. Then it would be up to Congress itself to vote on a package to reach that figure. Many feel that without automatic enforcement Congress will revert to the paralysis that characterized much of its re cent Effort to Cope with the spiralling deficit. Former Senate majority Leader Howard Baker in a Friend of the court Legal Brief told the justices that Gramm Rudman s automatic mechanism represents the Only realistic Hope of a required balance Between revenues and  without it he said Congress won t Deal with the Federal debt crisis which has been escalating without correction for the Las two  the National debt recently passed the $2 trillion Mark More than twice what it was when president Reagan took office.
