The 33-year-old,twins, Philip and Paul Malone who have been with the fir department for 10 years were sus Pended without pay in August for Alleg edly misrepresenting their race As a minority. They Are awaiting an Appeal of their Case in the state supreme judicial court. J. As a result the racial backgrounds of 36 other firefighters have  gated according to department officials. Eleven firefighters most of whom identified themselves As hispanic face near Ings but arc still working. The police department was investigated As Well but no evidence of minority misrepresentation was found. A re View of the City school department is ongoing. The Malonis have refused to discus their Case. They both arc working at other jobs but Hope to return to the fir department. Their wives Marsha and Janet have spoken briefly with report ers. It All comes Down to who says who is Lack and How Black do you have to be Marsha Malone Philip Malone s wife said recently. We re trying to be optimistic because they want their  the twins first applied to the fire department in 1975, identifying themselves As White. But their scores on the state Philip Malone civil service a am were too Low for acceptance into the department. They look the test again two year Slater and identified themselves As Black. They later explained that their Mother told them in 1976 that their maternal great grandmother was Black. At the time documentation was not required to Back up their claim. By 1978, when the twins got their Job there was a minority preference plan in effect and their scores were sufficient for them to be hired As minorities. The controversy Over their claims to be Black arose earlier this year when the twins took the lieutenant s exam and scored Well said fire department spokesman Matthew Corbett. When state civil service officials re turned the list of scores the Brothers were identified As Black. Corbel and fire commissioner Leo Stapleton who both worked with the Malonis in a station House have said they never knew the Malonis had been hired As minorities until they saw the indications on the exams. Boston instituted a minority prefer inc hiring plan after a Federal judge or Decd the fire department in 1974 to coring minority representation up to Icv Els comparable to the City s population. At that time just 19 of More than2,100 City firefighters were Black or his panic. Today the department is 21 per cent Black or hispanic compared to 29 percent for the City s population. It s a very serious situation said City councilman Bruce c. Boiling who is Black and who represents a predominantly Black Section of the City. He had asked mayor Raymond Flynn to conduct an investigation of minority hiring after the Malone Case was publicized. Mercado died Friday night at Jackson memorial Hospital and the department decided to suspend the officers after an autopsy saturday. � police originally said Mercado was injured in a struggle that broke out when three officers approached him for questioning and he ran into the House and tried to grab a knife. Though the deadline for primary candidates ended monday Independent candidates have until mid january to file for the remaining two years of washing ton s second term. Republican candidates include her Bert Sohn a physician lawyer who ran unsuccessfully for Congress three times against Veteran rep. Sidne Yalcs Kenneth r. Hurst who filed an unsuccessful lawsuit to try to get the election put off until 1989 and John j. Holowski a former Democrat employed by the City s department of economic development. Winning the democratic primary has been tantamount to winning the general election in Chicago s recent history Al though a White Republican made a Strong showing against Washington the City s first Black mayor. The racial Issue remains alive Inthis Campaign. Sawyer and Evans who arc Black arc battling to rep resent the Black Community although Daley has begun campaigning hard for the Black vote. Evans has criticized Sawyer and said he not Sawyer,.is Washington s True political heir. The City s population is a Little More than 40 percent White 40 percent Black is percent hispanic and less than 5 per cent of other races.
