Montana fishing guide client billed $2.78 million for Cost of fighting fire Helena Mont. Not a Montana fishing guide and his client got a Bill last week for $2.78 million from the . Forest service along with an addressed return envelope. The service wants reimbursement for the Cost of fighting a fire last fall in Southern Montana. The problem said Joseph Sabol a lawyer for the guide Vernon Smith who runs an outfitting service in Boz Man is that Smith docs not believe he was responsible for the hell roaring Creek fire that burned 52,600 acres in the National Forest and 29,300 acres in Yellowstone National Park. And even if his client was guilty Sabol said he docs not have the $2.78 million the Forest service is demanding. He s gotten a lot of bad press and been forced to sell his equipment and his pack string Sabol said. His life has been shattered. Obviously he s not in a position to pay a Bill like that. We Don t believe we re responsible and we re not going to a Forest service spokesman in Gallatin Jim Sanders said an investigation just after the fire started in the Absaraka Bra tooth wilderness area showed it might have been caused by a stove left burning in a ten occupied by Todd Wilkof of Canton Ohio who was on a sightseeing trip with a guide employed by Smith. Smith was not at the Camp when the fire started. Sanders said a fire in the stove and perhaps another stove in a different tent were left unattended when the visitors went fishing for the Day. Sanders said the Forest service had no Choice but to seek reimbursement for the fire. The total amount has not been determined he said. But he added that when All the costs were tallied including equipment and personnel costs it would probably be close to $4.5 million. If so he said Smith and Wilkof would receive a revised Bill. Wilkof could not immediately be reached for comment. We re governed by Law and have to Send the Bills Sanders we receive All the Money or none it s some thing we have to proceed if payment is not received it will be up to Federal attorneys to decide How to Pur sue the matter he said. Sabol said the letter containing the Bill included instructions on whom the Check should be made out to and a pc addressed envelope for your Conven but should Smith choose to pay the Bill he will have to provide his own stamp. If the Bill is not paid by june 21, there is a 9.75 percent interest charge on the balance and a Penally of 6 percent a year. Sabol contends that the Forest service is pressing the Case As a face saving Mea sure after fires destroyed vast areas of limb Rland last summer and fall. There s Little doubt in my mind they re looking for a Scapegoat Sabol other fires were started by Light Ning strikes he said
