Under terms of the agreement Milken will not plead guilty to any charges of racketeering or insider trading the sources said. Rather the charges focus on fraudulent activities involving securities trading. In pleading guilty to six lesser charges Milken appears to have avoided the much longer prison sentence that would have been Likely had he been convicted of the harsher counts of insider trading and racketeering. A single racketeering count would have carried a 20-year sentence. It was unclear whether the government would recommend a specific sentence to . District judge Kimba Wood. Milken would face a maximum of up to 30 years in prison on the six felony counts. But prosecutors could recommend that Milken serve the counts concurrently for a maximum term of five years in prison. Milken and two others including his brother Lowell were indicted last year on 98 counts of securities fraud and racketeering related to insider trading and other securities violations in a series of takeover deals from 1985 to 1987.
