The 4th District court of appeals ruled the Law establishing the program the nations first to provide state funded vouchers for private school education was unconstitutional because it was passed As part of an omnibus state budget Bill. The Wisconsin Constitution forbids lawmakers from enacting a a local programs in state budget Bills the appeals court said. The court did not address critics arguments that the program was unconstitutional because it undermines Public education by shifting state Money to private schools not directly under the states control. Gov. Tommy g. Thompson a staunch supporter of the school Choice plan said he was dismayed the appeals court did no to address the programs merits. A the program is working.
