The court agreed to review a Wisconsin court ruling that struck Down the states a hate crime Law. The Law authorized longer prison terms for defendants who chose their victims because of race religion disability or sexual orientation. The supreme courts decision is expected by july. The Law was challenged by a Black Man whose sentence for beating a White youth was doubled. The Man Todd Mitchell said the Law violated the constitutions first amendment by punishing speech. At least 20 other states have similar Laws authorizing longer sentences for crimes motivated by racial or other Bias and nearly every state has a hate crime Law. Last june the supreme court unanimously struck Down a St. Paul minn., ordinance that banned Cross burnings Swastika displays and other expressions of racial Bias. The court said the ordinance violated the constitutions free speech Protection because it sought to ban some viewpoints. But that decision did not say whether states May require extra punishment for other crimes when the de \ Pendant acted because of racial or other Bias. In the Wisconsin Case Mitchell was convicted of aggravated Battery in the october 1989 beating of a 14-year-old White youth in Kenosha. Mitchells prison term was doubled to four years under the hate crime Law after a jury found that he chose his victim because of the youths race.
