He said the two women suffered intensely from the cold and Schluger was so incapacitated that she had trouble skiing tuesday. During their 30 hours in the Cabin they burned furniture and kerosene to keep warm. The three had Only two sleeping bags because Schluger had dumped her Backpack and sleeping bag after having trouble keeping up. Dee Dubin and Schluger were hospitalized with frostbite. Brown also suffered frostbite on three fingers but was t hospitalized. We just did what you do in the mountains to survive Dubin said. After the snowstorm hit Torp and Brown the most experienced skiers in the group split from the others to find a route out. Torp said he and Brown spent two nights in the open  shelter or sleeping bags but found a Ranger Cabin sunday night in the abandoned mining town of Dorchester near Taylor Park. Defense Calls for mistrial n Case los Angeles a defense attorneys demanded a mistrial at the Start ing Gate in the Rodney g. King beating Case after a Black juror was accused of Bias. A dispute also erupted tuesday Over whether defendant Timothy wind s at Torney would continue to represent him. An irritated . District judge John g. Davics held two hearings behind closed doors and put off a ruling on a mistrial until wednesday postponing opening statements in the racially volatile Case until at least today. Three alternate jurors had yet to be chosen when defense attorney Ira Sajez Man who represents Koon said a White prospective juror who had been excused from the Case called him to allege that a Black woman on the jury had made disdainful comments about defense attorneys barring Blacks from the jury. With this new information i cannot accept this jury As constituted Salzman said. This is an attempt to provoke a mis trial after the jury is sworn because the defense is unhappy with the composition of the jury,".said assistant . Attorney Steven Cly Myrv the White Man was summoned to Courland questioned. The judge barred Law yers from disclosing what happened but the defense mistrial request suggested that Davics had refused to remove the woman a postal worker from the jury the jury sworn in monday for the fed eral trial includes two Blacks. During jury selection the defense lost a bid to re move a Black Man when the judge deemed the move racially based. A state jury with nor Blacks acquitted the four of most charges last year touch ing off riots that killed 53 people and caused $1 billion in damage. The mistrial motions became Public when defense attorney Paul Depasquale said in court that he was withdrawing his request because his representation of wind was Uncertain. Wind a Rookie offi cer fired after the beating had refused to sign a waiver freeing Depasquale from claims that the lawyer has a conflict of in Terest. Depasquale is a former Law partner of Michael Stone who represents Powell. Conceivably Depasquale was privy to in formation about Powell s defense
