Willis Las vegas a coach Jerry tar kanian moved from the basketball court to a court of Law monday launching a High powered offensive attack on the Mcaa in an Effort to keep his Post at the University of Nevada Las vegas. Univ president or. Donald Baepler suspended Tarkanian earlier this month at the recommendation of the National collegiate athletic association. The suspension was part of a two year probation slapped on the univ basketball program for numerous alleged violations of Mcaa bylaws. Baepler explained that he had no Choice in the matter suspend Tarkanian or face a stiffer sentence from the Mcaa. Tarkanian immediately obtained a temporary restraining order prohibiting the University from enforcing the suspension and he was in court monday to get a per manent injunction. The basics of Tarkanian s arguments Are that his rights to due process were Vio lated by the tactics used by Mcaa investigators. One investigator in particular. David Berst was grilled in absent a monday by Tarkanian s attorney Sam Lionel. Lionel accused Berst of making false statements about Tarkanian before the Mcaa committee on infractions. He also questioned Berst s methods and motivation in the Case accusing Berst of using Jerry Tarkanian. There was never any competent Legal evidence submitted by the Mcaa investigators Rivera said. Rivera said thousands of hours were spent on the probe by the University but that the Mcaa frustrated his attempts to prepare a defense for the University by not giving him guidelines in making his Case. Rivera said the Mcaa s action of not let Ting univ know what rules to go by Cre ated an absolutely impossible situation part of Tarkanian s defense against the suspension was an offensive weapon called the Pink file.1 the Pink file was produced by Leav itt and details the alleged improprieties used by Mcaa investigators in getting in formation about Tarkanian and the univer sity. In addition to statements against the University Lionel said the threats used to obtain the right answers to questions about Tarkanian included alleged com ments by Berst that Tarkanian exploited Black athletes. In his final arguments Lionel argued that the Mcaa in effect is denying Tarka Nian the right to he also argued that the suspension would Cost Tarkanian dearly in the pocket Book and he produced some evidence in that direction. Under the terms of the suspension tar kanian would still get his University salary but he would probably lose some outside income from being reassigned to other duties besides basketball coaching.
