By a 7-2 vote in a Case from Runton wash., the court said communities May use their zoning Powers to pre serve the Quality of Urban life by relegating All adult movie houses to one isolated area or by requiring that the Heaters be scattered. The court had said that much in 1976, but tuesday s decision is a key one because it frees communities especially smaller ones from having to wait to see what effect adult movie Heaters have before restricting them. The justices said Runton which had no such Heaters in 1981 when it passed a zoning ordinance could rely on the experiences of other larger cities to assume that adult Heaters would be harmful although the ruling discussed Only Heaters its rationale is applicable to adult bookstores and other establishments featuring sexually explicit materials. The ruling came just one Day after the High court barred cities from trying to Battle pornography by subject ing its distributors to lawsuits charging sex discrimination against women. The court on monday struck Down As an impermissible interference with Freedom of speech an Indianapolis Ordi Nance that imposed such Legal liability on pornography paddlers. Circuit court of appeals struck Down the ordinance in 1984, ruling that it violated free speech rights. Fellowships Grants linked to status of College Loans Washington a the National endowment for the humanities announced tuesday that it will not award any Grants or fellowships to applicants who Are delinquent in repaying government backed College Loans. John Agresto the acting chairman of the endowment said it will require applicants to declare their loan status when they apply for Grants and fellowships and will seek the education department s help in identifying delinquents. Fairness to other applicants honesty in scholarship and respect for the american taxpayers who pay for these awards require hat we be exceedingly careful with the funds entrusted to this Agency Agresto said. We also Hope this measure will encourage people to get Back on track and satisfy the loan obligations they have  the endowment is an Independent Federal Agency established in 1965. It uses its current $138.6 million budget to underwrite a variety of research scholarship education and Public programs in the humanities with government funds. Education Secretary William Bennett said in August that he had asked the internal Revenue service to with hold 1985 income tax refunds from 1 million loan delinquents and served notice on an additional 1 million defaulters that they would lose their refunds if they did t pay. At the same time Bennett predicted that government payments on defaulted student Loans would jump from $749 million to $1.08 billion in the fiscal year that ended last sept. 30. He said an education department study indicated that the default rate on guaranteed student Loans would Rise from 10.7 percent to 11.7 percent in fiscal 1985, and would increase to 13.6 percent by 1990
