If someone has been suggesting George is an irregular Guy i must have missed it. Even we avid readers of Usa today can t keep up on All the current events. No matter. George has any number of other Down to Earth characteristics according to the news accounts. Tabasco i recall was one. He flavors most everything with Tabasco sauce even one must pre sume his Tofu. But i could t help wondering when was the last time that George had real honest to goodness Dow Home pork rinds the kind made from scratch. On the outside Chance he might have lost the recipe in Between Texas Maine and Connecticut i asked my Friend the egg lady of Rocky Hill How she goes about cooking up a mess of hog hide that being what Rocky Hillian Call pork rinds. In fact i d go so far As to suggest that these Days silly and Fluffy Are probably the last things in the world he wants to be identified with. Cox news service Justice was t served in House vote on judge when the clerk called the Roll in the House on aug. 3, the vote was 413-3 to impeach judge Alcee Hastings. If this correspondent had been present and voting the count would have been 413-4. The House has done a most regrettable thing. Early next year it now appears the Senate will try Hastings. The overwhelming vote in the House suggests that the Senate will convict the judge and remove him from office. This May improve the character of the Federal Bench in Florida but the improvement will come at a Price. The Senate will have to turn its Back upon a Prin Ciple embedded in the Bill of rights. No person says the Constitution shall be subject for the same offence to be twice put in jeopardy of life or  the facts of this sad Case Are not in dispute. In the summer of 1981 the Fri got wind of an apparent bribery scheme. A Washington d.c., lawyer William Bor Ders gulled a couple of criminal defendants into be Lieving that Hastings could be bribed on payment of $ 150,000 the judge would treat them softly. Borders was tried convicted and sent to prison. The Case against him was airtight. In february 1983, Hast Ings was tried separately. The Case against him was wholly circumstantial. Hastings was acquitted. That is the key fact that cries out for recognition he was acquitted an impartial jury listening to the witnesses against Hastings observing their Demeanour weighing the conflicting Tes Timony refused to find Hastings guilty beyond a reasonable doubt. The jury set him free. Thereafter two of Hastings fellow judges set in motion a Post trial investigation that led ultimately to last week s vote in the House. The judicial conference and later the House judiciary committee found Clear and convincing evidence that Hastings had lied on the witness stand. The House accepted that View. After a Good Many hours of poring Over the House committee hearings i too am convinced that Hastings was a knowing participant in the bribery scheme. His Panicky behaviour at the time of Borders arrest was wildly inconsistent with innocence. Nothing can plausibly explain Hastings appearance at a Given time in a Given restaurant the better to satisfy the defendants that he was ready to be bribed. I look at this gifted and flamboyant judge and i am reminded of John Randolph s comment on Edward Livingston he is a Man of splendid abilities but utterly corrupt. Like Rotten Mackerel by Moonlight he both shines and  my opinion is immaterial. It is the trial jury s Opin Ion that counts. With one exception the articles of impeachment against Hastings involve the identical charges on which he was tried and acquitted in 1983. The exception accuses the judge of leaking the find Ings of a wiretap in a wholly different matter yes i know perfectly Well that the principle of double jeopardy does not apply in proceedings to impeach. During House debate last week one speaker after another arose to make that Point Conyers of Michigan Gekas of Pennsyl Vania fish of new York Rodino of new Jersey. These gentlemen Are lawyers All. They correctly stated the Law. But those of us who Are not lawyers May be forgiven the Blunt observation that if the forthcoming trial in the Senate is not double jeopardy de Jure it sure As hell is double jeopardy de Facto. House managers contend that the prolonged Post trial investigation produced new evidence of Hastings perjury. They cited 13 such items. Not a one of them was impressive. Not a one of them traced a Dollar of bribe Mondy to Hastings pocket. One of these items had to do with testimony that might have been Given by a linguistic expert who Analysed a recorded conversation Between Hastings and Borders. The expert pronounced at great length to the effect that us huh did not mean us  it would have been a Lovely experience to hear a skilled Cross examiner take that linguistic expert apart. The Point is that the government had its Chance at Hastings five years ago. This new evidence could have been turned up at the time. Under our system of criminal jurisprudence the government gets one crack Only. The government tried to rid the Bench of this troublesome judge and the government failed. No one doubts the importance of absolute integrity on the Federal Bench. Of course this is important. But Fidelity to constitutional principle also is important. The Senate i Hope will keep that in mind when it tries Alcee Hastings next year.
