Up Rich Daly the Missouri assistant basketball coach charged with unethical conduct tuesday had his Appeal upheld by the Mcaa and the charges dropped. Dalys conduct came into question Over his recruitment of several top players in the Detroit area including 1990 big eight conference player of the year Doug Smith. The Mcaa committee on infractions originally ruled Daly guilty of misconduct after he failed to remember details of a recruiting trip in Detroit. Of particular concern was his use of a private plane. Daly appealed the ruling june 29. D. Alan Williams the chairman of the infractions committee said the assistant coach and his lawyer cleared up some of the questions. Quot in a statement the Mcaa said a last november the committee determined that Daly knowingly provided misleading information by failing to be forthcoming during his appearance before the committee. The committee found his frequent lapses of memory and inability to recall specific matters a particularly about a specific recruiting trip via private air plane on an easter sunday a not to be credible. A last month however the committee reviewed new inform nation regarding this Case. This new information related to an easter recruiting trip. For the flight in question the name of the assistant coach was not on the air planet a  Williams said the committee partly based its decision on the air plane s log and Dalys clarifications. Williams in a Telephone interview said Dalys explanation showed a carelessness and sloppiness in record keeping by the assistant coach and the basketball program. He said the school has since improved its accounting procedures. A i do not see this of a vindication of the program a Williams said. A there were serious violations found and a serious Lack of  Bob Sundvold another Missouri assistant coach was charged with improper recruiting last season. His recruitment of . Mays triggered an Mcaa investigation of the Missouri basketball team. Sundvold and Daly resigned from the Missouri staff last March 1. Sundvold did not Appeal the no aah a ruling and has since taken a Job on the staff at Southwest Missouri state. The charges against Daly and Sundvold were part of last november a ruling in which Missouri a basketball team was placed on two years probation. The tigers won the 1991 big eight tournament but were banned from postseason play. They also face restrictions on off Campus recruiting and basketball scholarships. The Missouri athletic department has been beset by trouble. Since feb. 27 there have been at least nine incidents in which football players have been arrested and charged with crimes ranging from assault to burglary to rape.
