Irs pays $500,000 to Settle lawsuit alleging persecution Miami a the internal reve nue service is paying $500,000 to a lawyer to Settle a lawsuit claiming that agents persecuted him because he defended a newspaper that reported the irs was involved in illegal activities. Miami attorney Daniel Neal Heller was twice convicted of tax evasion but both convictions were overturned on a peal once because of jury prejudice and once because of a court s finding that an irs agent had intimidated a witness into perjury. Dennis Kainen who represents defendant Dore Eri Kaplan an irs agent in new Hampshire said the $500,000 is probably what it would have Cost to de fend this Case on trial and Heller a prominent civil lawyer who once represented the now defunct Miami news claimed that the agents pursued him after he defended the newspaper s refusal to divulge confidential sources for a 1975 series about an irs investigation dubbed operation the newspaper had reported that agents illegally monitored the lifestyles of judges and politicians. The report led to congressional investigations. Plave said the tax investigation originated through Normal channels he was assigned the Case by his Boss after it was referred to the criminal division in 1979 by Kaplan. In 1983, a jury found Heller guilty of using his firm s Trust account to conceal $450,000 and avoid paying $260,000 in taxes. But in 1986, the Lith . Circuit court of appeals in Atlanta overturned the conviction noting that jurors made anti semitic remarks about Heller during the trial and deliberations. Tried again in 1986, Heller was convicted by another jury and ended up spending four months in the Federal Pris on at Eglin fab in Florida. A year later the appeals court again ruled in Heller s favor. The court said Plave had intimidated Heller s accountant Leonard Safra into delivering perjured testimony for the government. Federal prosecutors refused to try the Case a third time. Heller and his wife sued the accountant s firm and collected a $5 million settlement from its insurance company the new York times reported wednesday.
