European Stars and Stripes (Newspaper) - September 06, 1977, Darmstadt, Hesse Page 12 the stars and stripes tuesday september 6, 1977 James j. Kilpatrick bureaucrats should pay for their blunders John Marshall Laid Down the Maxim Long ago that the Power to tax involves the Power to destroy. If the great Jurist were identifying the oppressions of government today he might recast the line the Power to sue involves the Power to destroy. Shelley Krasnow s Small corporation is not about to be destroyed but it tribulations provide an instructive Story. Krasnow is president of Georato corporation a Small manufacturing company in Manassas a. It employs 50 to 60 employ is who produce Bushless generators. The company has been in business for 40 Yea Sand is a successful reputable highly regarded Small the Spring of 1974. The company advertised to fill a vacancy of Secretary tothe manager of marketing and sales. A Batch of applications came in. These were winnowed to six or seven Likely prospects. All of them were women. They were invited to come in for personal interviews on april 4.among those interviewed was a Jane Doe a married woman in her late twenties. In the Best recollection of Georato executives her interview was Condu Tedas routinely As the others. In the end an other candidate was hired. A letter of thanks and regret went As a Courtesy to mrs. three months later on june 28, company executives were flabbergasted Tobe served with a complaint that had been filed with the equal employment opportunities commission in Washington. Mrs. Doe had charged Georato with unlawful discrimination on account of sex. Krasnow wrote the Leoc at once asking for de tails. This mind you was in the summer of 1974. On March 5, 1976, some 21 months later Krasnow finally got a reply from thee Etc. He was ordered to make himself available on March 11 for on the scene investigation and interrogation. It now appeared that Georato was no longer charged with discrimination by reason of sex. Mrs. Doe had acknowledged that shews not denied employment because she was a woman. However she contended she had been rudely interrogated and the questions asked were because of my had been asked if she were pregnant. Nothing under the Moon or Sun an certainly nothing in the Law creating the Leoc imposes any Federal liability for rude interrogation but that is the summand substance of the charge against Kras now s company. The whole proceeding i beyond belief. Krasnow wrote the Leoc on the very same Day saying he could not make a March 11 meeting and adding that while the executives who interviewed mrs. Doe had no recollection of any rudeness what Ever if the Young woman Felt All that of fended he willingly would thought perhaps that would suf was wrong. To shorten a Long Story the Leoc hit the company in May of 1976with a formal subpoena. The Leoc demanded exhaustive information on the company s employment by sex and race. I called for documents memoranda notes applications and statements of the Rea sons Why mrs. Doe was not hired and someone else was hired. Krasnow asked Why the subpoena it was because he was following the subpoena another year s hiatus set Ini last week three years and four months to the Day after mrs. Doe came in the Leoc renewed its prosecution with new demands for comply have urged this before and i urge it again Congress should enact a Law of Gen eral application to All Federal agencies aimed at reimbursing the victims of governmental harassment. This idiotic proceeding against the Georato corporation is nowhere. Krasnow has petitioned a fed eral court for dismissal the court almost certainly will Grant his motion. But the company will have lost thousands of Dol Lars in counsel fees and executive ought to be some Way that Kras now could sue not Only the government generally but also his named persecutors within the Leoc. If the arrogant bureaucrats who infest Wasington were made personally liable for the consequences of their blunders perhaps we would see fewer blunders. C Washington Star Syndicate Jesse Jackson i _ oct. T Chicago disaster in the making this is the Story of the City that carries what might be called the heaviest official Burden of racial oppression i America today. It is a Burden so heavy and hate fuelled that it could explode at any time. All this i documented in careful and legalistic Lan Guage that camouflages the desperate True character of the situation. The City is Chicago. The documentation for this disaster in the making is in stacks of stacks of files most of them in the City Dirksen Federal building where the City s attorneys have shuffled delayed an denied for years that the City discriminates in its police and fire departments i hiring for Public jobs in teaching children and assigning teachers and in building Public housing. If these shabby tactics of the City s leadership in resisting the United states Law and policies on race Are not convincing Evi Dence of racism then there Are other exhibits to consider. In the City s Marquette Park District Blacks demonstrating in Pursuit of their human and Legal rights to move and live where Thev please have been met by bricks rocks chains and baseball bats and blood curdling howls of hate. Earlier in the summer in the suburb South of the City Young Blacks celebrating a graduation picnic became embroiled in a columns comments Melee with resentful Whites. Blacks using Lake Michigan beaches on the City s predominately White North Side have reported being attacked and beaten. And in the White Community of Bridge port Whites who were visited by Black friends were threatened by neighbors. Another incidents Blacks shopping in Bridge port were attacked their cars damaged. It is not entirely coincidental that Nob Lack Ever has been Able to live than a few terror filled nights in Bridgeport is perhaps an appropriate Symbol of the City s official attitude since not a single Black family resides in the Community that has been the Birthplace and Home for most of Chicago s modern Day mayors including the late Richard Daley and his successor Michael hottest evidence of Chicago s legacy of racial tension is neither dramatic no traumatic. The real resistance is hidden in the carefully modulated Legal Lingo which is spoken in the handsome panelled court rooms and offices where for More than decade the City has battled among other issues the following a Federal judge s order that Public hous ing cannot be built exclusively in poor and Black Federal judge s finding that the City s police hiring practices were unquestionably prejudiced and , a suit alleging similar con duct in the fire department drags a state Board s finding that students Are assigned to schools in a discriminator Way is being debated. The Federal government found that principals and teachers Are assigned on the basis of their race the answer has Bee foot dragging disguised As compliance. The City s official resistance has Cost it citizens millions of dollars because it has had to borrow heavily to finance operations while the Federal government at tempting to coerce cooperation has bottled up funds for every conceivable service and project. But most tragically the silent Low pro file but so obvious racist will of the City leaders has undermined the citizens spirit j a 1, the last Hope of Chicago or c los Angeles times the opinions expressed in the columns and cartoons on this Page represent those of the authors and Are in no Way to be considered As representing the views of the stars and stripes or the United states government
