The department directed the firms Gen eral dynamics and Hercules inc., to show Why they should not be barred from doing business with the Federal government. In a separate action the labor depart ment asked a Federal court in Montgom Ery ala., to Issue civil and criminal contempt citations against the great at lactic and Pacific Tea co. The action stems from a 1975 court order enjoining a a from violating overtime and record keeping provisions of the fair labor standards act in a number of South Eastern states. Under the Law companies which hold government con tracts cannot discriminate against Handi capped persons and must take positive Steps to hire and promote such persons. The department said however there was Little risk of that happening and found that the Man is now employed in a similar Job with another company. Hercules was charged with firing a Man who was considered physically unsuitable because of a disease that might have required surgery. But the labor depart ment said it found the Man qualified to per form the duties the Job required. In the a a Case the labor department asked the court to order the company to pay any Back wages due employees because of a a s alleged failure to comply with a 1975 court order involving overtime and record keeping violations. The 1975 order resulted in a $200,000 judgment against a a for overtime compensation due employees in Alabama ten Nessee North Carolina South Carolina Georgia and Florida.
