Whitworth espionage trial opens in san Francisco san Francisco a trial opened monday for Jerry Whitworth a for Mer Navy code expert charged with Selling secrets As part of a spy ring for the soviet Union with the prosecution seeking to admit As evidence Anonymous letters that the judge has called a virtual . District judge John Vukasin deferred a ruling on whether to admit the letters to the Fri that speak of involvement in a spy ring and that prosecutors say were written by the defendant. Whitworth 46, is the last of four defendants accused of being part of a spy ring authorities say was headed by John Walker jr., a former chief warrant officer who has been convicted of espionage. Walker s son and brother also have been convicted. All four men were arrested in May. Jury selection was to begin tuesday with the trial expected to last eight to 10 weeks. Only someone with Whitworth s unique knowledge of an espionage conspiracy could have written the four letters to the Fri assistant . Attorney William Farmer argued monday in seeking their admission As evidence. Three letters spoke of involvement in espionage and offered help in breaking a spy ring in return for immunity from prosecution and the fourth retracted the offer. Defense lawyer James Larson said the details of the spy operation and Whit Worth s alleged knowledge of it would be a photo Jerry Whitworth. Accused of Selling secrets established Only if the jury believed John Walker who is expected to be the prosecution s Star witness. Whitworth s lawyers sought monday to require a separate trial on the tax charges saying they were not closely related to the espionage charges. Larson also said Whit Worth s Case would be Hurt because he wants to testify about the spying charges but not about the tax matters. Assistant . Attorney Leida Schoggen argued that All the charges were closely related and that Whitworth s spending of Large sums of Cash would be used As proof of both espionage and tax evasion. For example she said witnesses would disclose that Whitworth spent about $15,000 in Cash in the month after Walker is alleged to have paid him $100,000 for secrets. Received by Fri much of monday s hearing entered on the letters signed rus that were received by the Fri in san Francisco. The Fri said the first three letters in May 1984, said the writer had been involved in espionage for several years and had passed top secret code information to a Contact who relayed it to soviet agents. Vukasin in december denied a request from prosecutors to present the letters to the jury so the panel could decide whether Whitworth wrote them. The judge said then that the letters amount to a confession and that there was no evidence of their authorship. But Farmer renewed his request monday with a two pronged argument. He cited the Content of the letters which he said pointed to Whitworth As their author and their writing style which a Syracuse University analyst had found similar to Whitworth s. The prosecutor said rus described a longtime spy ring with at least five Mem Bers mentioned cryptographic key lists said the information was to be delivered to the soviet Union outside the United states and described the Contact As a Friend and . Citizen who received Money and instructions from his soviet Contact in the United states. The matters disclosed by rus. Were so obscure that Only or. Whitworth could have been the author Farmer claimed. In addition Farmer offered a report from professor Murray Miron of Syracuse University who often analyses disputed documents for Law enforcement agencies. Miron compared stylistic traits of the rus letters with letters found in Whitworth s Home and found enough similarities mis Spellings the use of punctuation and other characteristics to conclude that Whit Worth wrote the rus letters Farmer said. But the prosecutor s suggestion that the letters be submitted to the jury with instructions to disregard them unless the jury decided Whitworth was the author was sharply disputed by the defense. Larson said the letters like a confession Are so prejudicial that no jury instruction to disregard them would provide enough Protection. He also said much of the information in the letters would have been known to the intelligence Community for example it was Well known that the soviets wanted cryptographic secrets and commonly met their contacts in Vienna.
