Carlucci in a move related tothe ongoing fraud investigation has banned the hiring of new Pentagon consultants. Carlucci signed the order earlier this week directing it at All of the military services As Well As the joint chiefs of staff his own staff and All defense Agen cies. In View of the recent attention Given the employment of consultants by the department of defense effective immediately and continuing through the remainder of the present administration new individual consultant appointments May not be made by Dod organizations Carlucci wrote. He said some exceptions May be pos sible to accommodate special problems or unique circumstances but All such requests for exceptions would have to be sent directly to him along with detailed  William Caldwell a Pentagon spokes Man declined to predict the Impact of five month ban on consultant hiring. The Pace of such hiring is frequently erratic depending upon funding an changes in priorities. Moreover the new ban does not apply to the hiring of consultants by defense contractors Caldwell noted. According to budget documents the defense department expected to spend $11.4 million this year hiring individual experts and consultants to assist with various studies. The ban would apply to them. The Pentagon s total consulting Bud get approaches $3.9 billion including such services As management support studies engineering and technical sup port for new weapons systems and com Puter work. The current fraud investigation has focused on the relationship Between Var ious defense contractors and their consultants not consultants hired by the Pentagon. Nonetheless As allegations about consultant activities have surfaced some congressional leaders have begun to question the Pentagon s own hiring practices. Sen. David h. Pryor d-ark., the chairman of a Senate governmental affairs subcommittee accused the Penta gon in june of keeping a Shadow government under wraps by failing to disclose How much Money it was spend ing on private consultants. The Pentagon subsequently denied that accusation releasing a detailed financial breakdown of its spending. The Justice department investigation which became Public in june centers on allegations that defense contractors routinely used outside consultants to obtain proprietary information on the bids of competitors and that the consultants May have paid bribes to Pentagon employees. Court upholds contempt fines against Yonkers 4 councilmen new York a a Federal appeals court Friday upheld contempt of court fines against the City of Yonkers and four City Council members who defied a Federal judge s order to vote for an integrated housing plan. The 2nd . Circuit court of appeals however modified the fines against the state s fourth largest City placing a $ 1 million a Day Cap. In a 39-Page opinion the appeals court also delayed imposition of the fines for seven Days to permit the City to seek an Appeal before the supreme court. Previously . District court judge Leonard san imposed fines on the City of $100 that would double daily quickly going into the millions and breaking the City s annual budget in less than a month. Sand also imposed $500-a-Day fines against the four councilmen and ordered their eventual jailing if they continued to balk at complying with his ruling. Those sanctions were suspended aug. 9 when the City and the four councilmen appealed to the 2nd Cir Cuit. If they had not been the Council members were scheduled to go to jail aug. 11. By aug. 9, the City had paid $12,700 in fines and each councilman had paid $3,500. In upholding the fines against the four councilmen the three judge appeals panel said the threat of jail would resume in nine  four councilmen had indicated thursday they would vote once again to defy the courts at a speciality Council meeting set for 2 . Friday. The defiant Council members said they had changed their minds about the desegregation plan which would create 800 units of affordable housing throughout the , who in 1985 found Yonkers liable for 40 years of segregated housing and schooling imposed the fines aug. 2 after the City Council refused by a 4-3 vote to endorse the housing  City had argued that Sand s contempt finding and fines were unfairly punishing Yonkers for the Defiance of renegade Council members who would not change their votes because of the political  for the Council members in turn argued that Sand exceeded his judicial discretion by ordering members of a legislative body to vote a certain  the 2nd circuit concluded that under the circumstances of this Case the recalcitrant Council Mem Bers May be required to vote to implement the consent judgment and that the City in addition to the Council members May be. They seek unspecified damages and changes in Fri policies. About 400 or 4.3 percent of the Fri s 9,400 agents Are hispanic com pared to about 8 percent of the general population. The plaintiffs attorneys Hugo Rodriguez and Antonio Silva complained tuesday and thursday that the Bureau has kept watch on them and possibly begun an investigation to discredit them. This is the Fri said Rodriguez who resigned from the Fri last year after 18 years. Witnesses called by the Fri denied the accusations. On tuesday Fri attorney Lainie Sim Ion tried to introduce into evidence a document concerning a closed investigation into whether Rodriguez and Silva were Selling arms to the nicaraguan con tra rebels. Bunton did not allow the document into evidence. No charges resulted fro the investigation which Rodriguez Dis missed As a groundless intimidation tac tic that he said was started after he re signed from the Fri. Perez the no. 2 agent in Elpaso filed the suit in january 1987
