The withholding generally is indicated on pay stubs As Pica or fed eral insurance contributions act. Although the suit was brought by 18 Union members in Bermuda him asked . Defense department civilians can file refund claims for the Pica withholding on their allowances at the conclusion of each tax year him said. Under current practice the irs will deny the claims. But if the sea wins its Case taxpayers will have to have the annual refund claims on hand in order to recoup the said that refund claims can be made retroactively As far Back As two years meaning that civilians May still have time to file claims for the 1987 tax year. Employees should Check with local tax experts about filing refund claims with the gave no hint of How or when he might Rule on the Case. He has heard from him and Justice department attorney Elizabeth Depriest who argued for the Pentagon s right to tax the allow pointed out that the state department which handles the payroll for non military employees overseas does not subject any overseas allowances to taxation. Ironically him said depart ment of the Treasury and irs employees overseas do not have Pica withheld from their overseas allowances. He said the sea intends to help its 5,300 members Challenge the with holding from their 1988 allowances and assist them in filing refund claims. He added that the Union will Appeal the Case to higher courts if necessary.
