European Stars and Stripes (Newspaper) - February 28, 1992, Darmstadt, Hesse Friday february 28, 1992 the stars and stripes a Page 5students win right to get damage supreme court clarifies 72 sex Bias Law by the new York times Washington the supreme court ruled wednesday that the Federal Law barring sex discrimination in schools and colleges permits students to sue for damages. In a 9-0 decision the court rejected the Bush administrations argument that the Law a title in of a 1972 education Law a does not authorize monetary damages As a remedy for illegal sex discrimination. In recent cases the supreme court has taken a narrow View of Federal civil rights Laws so lawyers for women a groups expressed Relief about wednesdays decision. They predicted it would convert the Little used 20-year-old Law into a powerful weapon against sex discrimination on Campus. A this is a major win that opens up title in dramatically a said Marcia Greenberger director of the National women a Law Center. A having a real remedy will give an enormous push for equity in schools and colleges she added. Until now there have been few lawsuits under title in. Although it is impossible to predict whether wednesdays ruling will increase the number dramatically there is no doubt that it offers a new remedy to students a men As Well As women a who feel they have been the victims of sex Bias. The new civil rights Law that was passed in the last session of Congress made damages for sex discrimination available for the first time. But that Law applies Only to employment discrimination and thus does not apply to students. The decision wednesday overturned a ruling by a Federal appeals court in Atlanta that had dismissed a title in suit against a Georgia school District. The suit was brought by a High school student who charged that officials had failed to Stop a teacher from forcing unwanted sexual attention on her for More than a year. The appeals court in a decision that the Bush administration asked the supreme court to uphold said title in authorized suits Only for Back pay or for an injunction ordering an end to the illegal activity. These remedies Are useless to most students who receive no pay in the first place and who typically will have graduated and Cut their ties to a school by the time a lawsuit can result in an injunction. Congress did not specify the remedies available under the 1972 Law which outlawed sex discrimination in any a education program or activity receiving Federal financial assistance a a description that covers All Public schools and colleges As Well As Many private ones. The administration argued that unless Congress explicitly provides for damages the courts should not make a damage remedy available. But Justice Byron r. Whites opinion for the court wednesday took the opposite approach concluding that a we presume inc availability of All appropriate remedies unless Congress has expressly indicated a this principle has deep roots in our jurisprudence a White of Houston president author Dies at 49 Houston up a Marguerite Ross Barnett president of the University of Houston and author of several books and articles on political science died of cancer at a Hospital in Hawaii.
