The court noted that although defense employees who declined to answer the questions might not receive a a a secret clearance that was necessary to fulfil their Job requirements there was nothing unconstitutional about asking the questions. Raymond Randolph the court said that the government has a valid and legitimate interest in asking employees about their arrest records their financial status and illegal drug use. Lawyers for the defense employees also had argued that asking the question about illegal drug use violated the employees fifth amendment right against self incrimination but the appeals court disagreed.
