Contracts policies simplified heretofore fading out by Louise Cook associated press writer have you Ever wondered what your insurance policy really says or tried to figure out who was the party of which part in your lease help is on the Way. Some of the Legal Mambo Turnbo is beginning to give Way to Plain language designed to make it easier for people to understand the contracts they sign. A new York state Law taking effect next june 1 requires simplified language on All residential leases and a wide Range of other contracts in which the Money involved will be used for personal family or household there has been some criticism of the Law for failing to spell put which contracts Are involved and what is meant by simplified language. A spokesman for the state consumer Protection Board said he expected the Bill would cover things like insurance and health policies Loans credit applications and instalment agreements. He predicted that the terms used will evolve with time. A spokesman for the Federal Trade commission said new York is the first state in the nation to pass such a Law. Similar measure is under consideration in Massachusetts however and Virginia lawmakers passed a Bill calling for the establishment of guidelines to make insurance forms More readable. The Etc spokesman noted that some of the Legal terms have a specific purpose. They Are often designed to make sure that a contract conforms to Legal precedents and will stand up in court. Citibank the nation s second largest commercial Bank was one of the first Busi Nesses to move toward simpler forms. With the Aid of a Reading consultant the Bank redesigned its loan agreement late in 1974, eliminating Many of the hereto Fores and other terms which had no real meaning. A similar Effort is under Way at the National Bank of Washington which in a recent advertisement noted that presi Dent Carter had promised to Cut govern ment regulations and make sure that rules Are written in simple English. Or. President the National Bank of Washington could t agree with you More said the company announcing it All Carter s Campaign Loans were both Legal and secured aide says Washington up president car ter s Campaign treasurer said Friday that All Carter s Campaign Loans were not Only completely Legal but also very sound and fully secured. Robert j. Lipshutz now the White House counsel also said in a memo that the prac Tice of obtaining Loans was common among political candidates. United press International obtained a copy of the memo prepared after new re Public Magazine had reported that during the final Days of the 1976 primaries Carter was tapping what looked like an unending and unsecured pipeline of the article said the Carter Campaign got $1.5 million in Atlanta Bank Loans from april to june 1976. The theme of this article seems to be that the Banks in Atlanta acted imprudently by extending Loans to the Carter Campaign Lipshutz said. Nothing could be further from the truth the Only loan which was made throughout the Campaign which was not fully collateral Zed by adequate accounts receivable was a loan of $100,000 which Jimmy Carter guaranteed that loan he said was made in april1976. It is interesting to note that Morris Udall borrowed $70,000 on his own Signa Ture alone and that Jimmy Carter Bor rowed 100,000 on his own signature alone Lipshutz said. The Arizona congressman was one of Carter s chief opponents. Lipshutz a former Atlanta attorney said the Campaign borrowed Money from time to time from the Fulton National Bank and the citizens and Southern National Bank both in Atlanta. Aside from the one loan secured by car ter s personal signature he said All other Loans made by Fulton were fully secured by Matching funds receivable due the Campaign from the Federal election committee. As for the is National he said each and every Carter loan there was fully secured by assignment of accounts Receiva ble from transportation accounts of the secret service and Media accompanying said All of these Bank Loans obviously were not Only completely leg Albut also very sound. Not Only because of the manner in which they were handled and the collateral which was taken but also by the fact that obviously Loans of this Type were thoroughly reviewed by Bank ing and Federal election auditors. The new Republic said Carter s opponents did Little Bank borrowing Udall $70,000 and sen. Henry m. Jackson d-wash., $42,700. With reference to the ability of inability of any other candidates to obtain Bank Loans we of course cannot comment lip Shutz said. However it is quite Well known that political candidates in this and other campaigns throughout the country have borrowed Money from Banks in connection with their political campaigns the Carter Campaign made All of its Loans in full compliance with All banking Laws and regulations As Well As with All Federal Campaign Laws and All new Ford for 78 planned to revamp All its consumer credit forms. The first of the new forms was introduced last month and Michael Melville vice president of the Bank s consumer department said the Bank s customers helped develop it. He said a research firm hired by the Bank interviewed 750 custom ers in 17 of the Bank s 25 branches about the proposed contract. Language not understood by a significant number of customers was changed. Some of the differences Between old and new Are dramatic. Take the Section on default. The old form says upon failure to make any pay ment As herein agreed or in the event of the death of the maker or in Case of insolvency bankruptcy or failure in business of any of the undersigned any or All of which occurrences shall constitute a default the entire remaining unpaid balance of this note together with any interest and charges thereon shall at the sole option of the Holder of the note become immediately due and payable in full without further demand or the new one reads if for any reason i fail to make any payment on time i shall be in default. The Bank can then demand immediate payment of the entire remain ing balance of this loan without giving anyone further a group of insurance companies Affili ated with the insurance services office a rate reviewing organization began distributing simplified homeowners policies in six states in 1976. The program will be expanded to 10 More states this fall and Winter. A spokesman for Kemper insurance co. Of Illinois one of the firms which switched to the simplified form said the new policy also was Shorter with 40 per cent fewer words and was printed in larger Type. He said a Check of agents in Illinois where the simplified policy was introduced in 1976 showed that people Are More Likely to read the new policy than they were the old one. New York state is not one of the areas in which Kemper has been issuing simplified policies and the spokesman said there Are indications that Consumers Are confused by existing forms. He said the company recently sent questionnaires to 8,000 policyholders asking for comments on service. Six per cent of the 1,500 persons who replied said they wanted policies that were easier to read. Explain coverage in everyday Lan Guage wrote one person. Make it so Clear that a 10-year-old can understand it said another. Of time the Fairmount Model being introduced by Ford for 1978 is expected to be the company s top seller.
