Defense costs will also be paid for All other Federal officials implicated but not indicted in possible criminal wrongdoing he said. The decision Means that while the department is prosecuting former Fri director l. Patrick Gray and two of his top aides for approving the illegal break ins it will also hire private lawyers to defend numer Ous agents who carried out their orders. Civiletti said in an interview that top department officials have spent Long hours wrangling Over when the government should defend Federal officials in civil suits. Concerned he said assistant attorney general bar Bara Babcock head of the civil division was particularly concerned Over two kinds of cases in making her decision where an official is under indictment and faces a civil suit for conduct similar to but not the same As the actions for which he was indicted. Where the official was not indicted for various reasons but is being sued for acts similar to those leading to prosecution of another official. Barbara has said the civil division can not sit As some kind of tin god and decide whether someone is guilty or not guilty in determining whether to provide counsel in civil cases Civiletti said. As a result he said except in cases where formal charges Are brought the government will for private defense lawyers for the employees involved. We have defended Fri agents from time to time where they have been sued civilly for wrongful conduct Civiletti said. Most of the Fri agents involved were part of the Bureau s squad 47 in new York which committed illegal break ins in a Hunt in the Early 1970s for fugitive Mem Bers of the Radical Weatherman group. Fed s Miller Calls for delay of social Security tax hike Washington a the chairman of the Federal Reserve Board urged con Gress on wednesday to strike a big blow against inflation by delaying for one year the $8 billion social Security tax increase due to take effect Jan. 1. G. William Miller also told the Senate finance committee that cutting the tax on capital gains would not be the Best method of increasing investment. Because businesses or employers share social Security costs on a 50-50 basis with workers these businesses presumably would increase prices to offset their $4 billion share of the scheduled tax increase thus fueling inflation. Miller said deferral of the social Security increase would reduce inflation next year by half a percentage Point. But he added that any such delay should be accompanied by a thorough study that could Lead to reduced social Security benefits. Temporary Rollback Miller recommended that the temporary Rollback be included in the income tax Cut Bill that the committee will begin writing on thursday. He urged the Senate to weigh carefully the size and shape of the tax Cut. A tax Cut certainly should provide no More stimulus than is necessary to sustain moderate economic expansion anything More could jeopardize our chances of re straining inflation Miller said. He said a tax Cut in the Vicinity of $15 billion. Would be the House voted for a $16.3 billion tax Cut for individuals and businesses an amount endorsed by the Carter administration. Miller apparently has changed his think ing about the tax Cut in recent weeks. He wrote to tvo senators on aug. 23 that a Cut of $15 billion to $20 billion would be Ideal with a third of it going to business. He said wednesday that the one Quarter business share in the House Bill seems about right. Cutting taxes beyond recommending a one year defer ral of higher social Security taxes Miller did not spell out How individual income taxes should be Cut. To head off bankruptcy of the social Security system Congress last december raised taxes starting Jan. 1, 1979. The so Cial Security tax increase next year will Range from $4 at the lowest income Levels to a maximum of $260 to be paid by those earning about $25,000 or More. Should Congress accept Miller s recommendation those increases would not take effect until 1980. In a statement that seemed to take some committee members by Surprise Miller cautioned Congress against making deep s. Africa rejects .
