It came thursday when House members on the committee eager to save at least part of the package dropped their insistence that the tax benefits also go to pupils in private elementary and secondary schools. The sticking Point was that most of the Aid to private school pupils would go to those in Church run schools something opponents said would violate the Constitution s provisions guaranteeing separation of Church and state. Senate members on the committee argued that rather than accept that the sen ate would be willing to sacrifice even the College credits. Faced with that possibility a few weeks before the november elections House members reluctantly agreed to let the col lege Aid stand alone. But House and Senate approval of the hard fought Compromise still would not guarantee final approval of the College credits. Even As the conferees were meeting president Carter was repeating to a news conference his concern about the whole Tui Tion credit concept. La. Police said the target apparently was one of two women in the car Barbara Smith the estranged wife of Leonard Smith who was arrested on a murder charge. Mrs. Smith was wounded by pellets. She and her sister another occupant were de scribed As go children of Turner. In Crown Point ind., Smith pleaded in Nocent Friday to first degree murder in the slaying of Bostock. Smith entered the plea during his arraignment before Lake county criminal court judge Andrew v. Giorgi. The suspect s attorney Nick Thiros filed motions asking the judge to set bail on the charge which carries a penalty of 30 to 60 years in prison and to Grant discovery the right to review All evidence in the Case. Glorvi set a hearing for oct. 12 on the bail motion and granted discovery to both prosecution and defense. The Lake county prosecutor s office said the next step will be to seek Smith s indictment by the county grand jury when it convenes in mid october. The Bill would allow a tax credit which is subtracted directly from taxes owed of 35 percent of tuition costs paid after july 31, 1978.
