The child abuse charges were dropped tuesday by st Charles county circuit judge Lucy Rauch said the attorney Wayne Schoeneberg of st. Charles. The three charges alleged Berry had filmed people under the age of 17 in the nude for the purposes of sexual gratification and stimulation. _ a felony charge of marijuana Possession was reduced to a Misdemeanour in the trial by court Schoeneberg said. He said Berry 64, pleaded not guilty to the Misdemeanour Possession of less than 35 Grams of marijuana but Rauch found him guilty and put him on unsupervised probation. The probation includes no restrictions on Berry a travel or appearances the attorney said. Prosecutors said 24 Grams of marijuana were found last june at a building in the singers Berry Park compound in Wentzville about 35 Miles West of st. Louis Berry sometimes spends the night there. Schonenberg said there was no evidence to connect Berry to any allegations regarding child abuse or child pornography. The attorney said the videotape on which the child abuse charges were based had not been seized by police during a raid at Berry a property but had been placed among the items confiscated from Berry a property by an informant. All of Berry a personal papers videotapes and rifles seized during the raid were returned to him Schoeneberg said. St. Charles county prosecutors announced in july they had seized evidence june 23 in the raid at Berry Park. Included were hashish marijuana weapons and More than $122,000 in Cash. Prosecuting attorney William Hannah admitted at the time that drug agents had been searching for cocaine during the raid but found none.
