Assistant state attorney Moira Lasch her voice cracking in an emotional Appeal for an immediate trial said Smith s lawyers Are trying to Wear Down the 29-Yea a old victim who dared to report a rape committed by a member of a prominent  the woman has told police that when she returned in so a a in a Edof Miry compound with Smith on March 30, he tackled her to the ground and raped her. Smiths trial on one felony count of sexual Battery and one Misdemeanour count of Battery was scheduled to begin monday but on wednesday the judge granted the defense request for a delay. Circuit court judge Mary Lupo has yet to set a new Date. Roy e. Lasch objected saying she would rather move the trial out of Palm Beach than wait that Long. The alleged victim has lost control of her life since the incident and wants the Case resolved Lasch argued. The defense in turn withdrew its request to move the trial from Palm Beach after polls showed that residents of Palm Beach May be More sympathetic to South than residents elsewhere. The defense originally had sought to move the trial because of a saturation coverage by the local Media. The prosecution Friday submitted into evidence a Public opinion poll. The National Law journal commissioned a Survey of 400 registered voters in Palm Beach county and 400 registered voters nationwide july 27 and 28. The Survey found 46 percent of the Palm Beach respondents who had formed an opinion thought Smith was guilty while 58 percent of respondents nationwide with an opinion believed he had raped the woman. The defense revealed wednesday that it had conducted its own poll of potential jurors in Palm Beach but its results were Kinder to Smith with 41 percent believing he was guilty.
