House seat rests with ruling Washington up the supreme court agreed on Friday to decide whether the 1990 census wrongfully included overseas military personnel an Issue that will help determine if Massachusetts loses a House seat and Washington state gains one. The court agreed to an Appeal by the Commerce department to hear the Case on an expedited basis. It set Oral arguments for april 21, with a decision expected by july. It Marks the second House reapportionment Challenge currently before the court. The justices also arc considering a Challenge by Montana to the Complex mathematical method adopted in 1941 for determining the proportion of House seats allowed to each state. A . District court in Massachusetts held that the Constitution and the census act allow military personnel stationed overseas and their dependents to be included in state population totals for apportionment purposes. But it ruled that the governments manner of doing so after the 1990 census was unjustified. The Bush administration contends that the lower court did not even have the right to consider the Issue. But if so it wants the High court to Rule that including the Federal personnel for House apportionment purposes was Legal. The census Bureau in 1990 counted overseas military personnel and their dependents and added them to a state s population based on their a Home of  Massachusetts says the process used to determine a service member a Home of record is flawed not reflecting where Many actually reside when not overseas. The lower court agreed ordering the census Bureau to disregard the 922,810 people it included from overseas. With the overseas personnel Massachusetts was entitled to 10 representatives in the upcoming reapportionment Down from its current 11 representatives determined by the 1980 census. By contrast Washington state would be entitled to nine seats up from its current eight. But if the overseas personnel Are excluded Massachusetts would remain at 11 seats while Washington would remain at eight. The Issue could be further complicated by the outcome of the Montana Case which also implicates Washington state on a different basis. The apportionment not Only will determine the number of congressional seats from each state in the 103rd Congress which sits in january 1993, but it also helps determine the number of electoral votes each state will have in november a presidential election. In 1970, the Commerce department which overseas the census Bureau for the first time included in state populations for reapportionment the a Home of record of overseas military personnel. The decision to do so was spurred by the Vietnam War. In the 1980 census the number of overseas personnel was again taken for total population purposes but was not included for apportionment. The Commerce department had not planned to include it in apportionment numbers for the 435 House scats in its 1990 census either but Strong congressional support prompted it to do so. Jimmy Doolittle staged a daring bomber attack on Tokyo a and then flew on to China where they put their lives in the hands of peasants and workers.
