Through a statement from his lawyer _ Cisneros disclosed that the investigation had moved into a new phase but said he was confident he would be vindicated. The Justice department s move was a procedural step that had been expected and it does not necessarily mean that the department will seek the appointment of an Independent counsel. At Issue Are 40 hours of audiotapes re corded secretly by Linda Medlar Cisne Ros former Girlfriend. Last month the Justice department opened an initial review of the matter that under the Independent counsel act had to be completed within 30 Days. The Law requires that attorney general Janet Reno turn the review into a prelim Inary inquiry if she finds specific evidence of wrongdoing from a credible source. If she then finds grounds for further investigation she must ask a special panel of Federal appeals court judges to name an Independent prosecutor. On Friday Cisneros said he was in formed by the Justice department that the Case had been turned into a preliminary inquiry. V while i had hoped that this matter would end during the first stage of the in Quiry Given the limited scope of that stage i understand Why it has moved into the next phase Cisneros said. I have made mistakes in judgment in my person Al life but i have always adhered to the Law i have not allowed this matter to Dis tract me from my duties at Law enforcement officials said the re View had not yet determined that Cisne Ros did anything wrong or unethical. Investigators Are expected to compare Cisneros comments on the tapes with other statements he made at the time of his appointment about the payments to Medlar which totalled More than $40,000 a year Between 1990 and 1993. Medlar has said that Cisneros deliberately underestimated the payments in statements to Clinton transition officials and Federal agents. Cisneros has acknowledged that he was concerned the payments might disqualify him from serving in the Cabinet but has said he was candid in describing them.
