They were released after lawyers old  judge Patrick Kelly that they would abide by his order that prohibits the blocking of Access to two Wichita abortion clinics and forbids the incitement of others to Block the clinics. Tucci and Mahoney denied they had agreed to obey any of Kelly a orders and specifically refused to disavow operation Rescue s tactics of blockading and sitting in at abortion and family planning clinics. Both also vowed to return to Wichita. They refused to say when but indicated it would not be soon. Operation Rescue began coordinating demonstrations outside Wichita abortion clinics july 15.
