A a judge denied stay tuesday and told a Mother to evict her 14-year old daughter before Sunset or report to jail in a Dis Pute Over deed restrictions that bar children younger than 15. I m mad. Nobody cares about Staci Beverly Elmer said after the ruling by Pasco circuit judge Wayne Cobb in Dade City. After school tuesday Staci went to the Home of married brother Darwin who lives about five Miles away. The judge ruled that she can visit her parents. Mrs. Elmer a real estate employee and her Hus band Thomas would have faced a 10-Day jail sen tence for contempt of court if they had not move the teen out by 5 . The elmers admit they knew that children under15 were prohibited when they moved into their Dou ble wide Mobile Home on the Back streets of the Small Rural Community in november 1987. The sub division which has no name covers two blocks and is Home to 17 families All retired except the elmers. The neighbors took the elmers to court and Ina gust a judge upheld the deed restrictions and or dered Staci out. The elmers did t Budge. Earlier this month another judge said he had no Choice but to find the couple in contempt and set the Jan. 31 deadline. The elmers attorney Mary Greenwood asked Obb tuesday for a stay until mid March when amendments to the Federal housing Law Banning age discrimination take effect. They Are expected to make the Case moot. Greenwood sought a delay and a hearing to clarify whether the teen Ager could have visiting privileges. Cobb refused the delay granted visitation and set a March 22 hearing Date to formalize tuesday s action. Staci who will be 15 on april 7, is a student who makes a s and b s and spends four nights a week practising Ballet acrobatics tap jazz and Pointe. I m not surprised she told her Mother. The More volunteers we have the better off Well  after washing her hands the first lad made a few of the 1,700 sandwiches that Are delivered daily by the facility s to bile soup Kitchen to some 700 homeless people in Washington. All of the food is donated by local merchants. The facility which she had visited in 1987, also has a children s Center that provides after school meals tutoring and playtime for some 50 homeless or poor youngster sages 2 to 14. Some of the children had a pretty Good idea what tuesday s event was about. The visitor was mrs. Washing ton one Little boy declared proudly As he awaited the arrival of Bush. A grandmother of 10, Bush walked inthe door and took command of the Chil Dren saying everybody quiet everybody sit Down  she sat in a Barbara Bush reads to homeless children at Martha s table in Washington plugging volunteerism on her first Outing As first lady. A wooden Rocker with children gathered around her and proceeded to read to them from a Book she had brought with her titled How Fletcher was hatched a Story of a dog that by an unusual turn of circumstances was encased in an egg. Bush summarized and paraphrased in an animated tone As she went along. This is the longest Book she sighed. She quizzed the children afterwards about details of the Story and asked them to howl like dogs. They did. She asked whether any one had a dog. No they said in  want to know our names one child asked. Yes i want to know your names the first lady replied and the listened As they introduced themselves. They clapped for her and then dashed forthe cookies she had brought them. 73-year-old Man Dies while stuck in garbage can pr�rii4cctcit it v / a r \ t7__ i Rochester . A for three Days a 73 year old Man sat stuck in a garbage can up to his Arm pits on his front porch dressed Only in a Nightshirt while temperatures dipped into the 20s. Now that he has been found dead the Community islet with a troubling question Why did t some body help Robert Hamm it was pretty strange said sgt. . Liepins who discovered Hamm on Jan. 25. We depend on people telling us if they see something unusual in the neigh boyhood so we can Check it out. That did t  a postman and an 11-year-old new girl saw him sitting in the can on the enclosed porch several feet from the door but neither realized he was in trouble. He waved to me and i acknowledged just like i done hundreds of times before said John vane the postman. It was a Nice Day and i just assumed he was sitting there Reading the paper and smoking a Cigar just like always vane said monday. As he walked away How Ever he thought something did Flook right but he said he did t go Back to take a second look. In retrospect i feel bad about what happened but really did t think anything was wrong he said. The new girl told her Mother Liepins said but the woman thought her daughter was exaggerating or see ing some kind of reflection. The girl told her the same thing the next Day an finally after the girl and her 13-year-old brother insisted the woman went to Hamm s Home two blocks away looked at the Man through the locked door on the enclosed porch and called police. I m just kicking myself for not taking this More seriously she told the Rochester times Union. Since talking about the incident the family has received death threats and prank phone Calls Liepins said. Hamm lived on a Corner lot in a Middle class residential neighbourhood in Rochester. ,. A funeral service monday at St. Monica s Catho Lic Church father Robert Gaudio told friends and relatives that they had to continue to have Faith despite Hamm s senseless death. In a ridiculous Situa  his son Martin said the family did not want to talk with the Media but he characterized reports in the local Media about his father As highly inaccurate and absolutely  some neighbors described Hamm As an eccentric and a Drinker. Others said he was lonely and appeared to be depressed. Liepins said investigators found Ope whiskey bottles in the two Story Wood Frame House. Authorities have speculated that Hamm suffered Aheart attack and slumped into the can after resting on its Edge. Or they say he May have fallen into the canard then suffered the heart attack. Or. Nicholas Forbes Monroe county medical examiner said Hamm died of a heart attack but it s not possible to determine when it happened. Liepins said the door to the porch was locked and he had to break a basement window to get into the House. He found some Money and other valuables so policed not suspect any foul play. The thing that really gets you Liepins said is imagining yourself in that position and not being a Leto get  �
